By accessing or using TestForge's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

TestForge provides an AI-powered end-to-end testing platform that enables users to record, manage, and execute automated tests for web applications.

The Service includes: - Browser-based test recording and playback - AI-assisted test generation and maintenance - Test execution and scheduling - Integration with CI/CD pipelines - Analytics and reporting dashboards - API access for programmatic control

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

To access certain features of the Service, you must register for an account. When you register, you agree to:

- Provide accurate, current, and complete information - Maintain and promptly update your account information - Maintain the security of your password and accept all risks of unauthorized access - Notify us immediately of any unauthorized use of your account - Be responsible for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activity.

Certain aspects of the Service require payment. By subscribing to a paid plan, you agree to:

**Billing:** You will be billed in advance on a recurring basis (monthly or annually) based on your chosen plan. Your subscription will automatically renew unless cancelled.

**Price Changes:** We may change our prices at any time. Price changes will take effect at the start of the next subscription period following notice to you.

**Refunds:** Subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy.

**Taxes:** You are responsible for all applicable taxes. We will charge tax when required by law.

You agree not to use the Service to:

- Violate any applicable laws or regulations - Infringe on the intellectual property rights of others - Transmit malware, viruses, or other malicious code - Attempt to gain unauthorized access to our systems - Interfere with or disrupt the Service or servers - Harass, abuse, or harm another person - Collect user information without consent - Engage in any activity that could damage TestForge's reputation

We reserve the right to investigate and take appropriate action against anyone who violates these prohibitions.

**Our Content:** The Service and its original content, features, and functionality are owned by TestForge and are protected by copyright, trademark, and other intellectual property laws.

**Your Content:** You retain ownership of any content you create using the Service, including tests, recordings, and configurations. By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

**Feedback:** Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to you.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that: - The Service will be uninterrupted or error-free - Defects will be corrected - The Service is free of viruses or other harmful components - The results obtained from the Service will be accurate or reliable

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESTFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless TestForge, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to:

- Your use of the Service - Your violation of these Terms - Your violation of any third-party rights - Any content you submit to the Service

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination: - Your right to use the Service will immediately cease - You may request an export of your data within 30 days - We may delete your data after 30 days - Provisions that should survive termination will remain in effect

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the "Last Updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.
